This policy explains how copyright owners and authorized agents may report alleged copyright infringement involving materials hosted on EliteFans.ai.

1. Introduction

EliteFans.ai (“EliteFans,” “we,” “us,” or “our”) respects the intellectual property rights of copyright holders and expects users of the Platform to do the same.

This Digital Millennium Copyright Act (“DMCA”) Policy explains how copyright owners or their authorized agents may submit notifications of alleged copyright infringement relating to materials hosted on EliteFans.ai.

This policy applies only to materials hosted on EliteFans.ai.

2. DMCA Compliance

EliteFans.ai complies with the Notice and Takedown provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512.

EliteFans qualifies as a “Service Provider” under 17 U.S.C. § 512(k)(1) and seeks to maintain eligibility for the safe-harbor protections provided under the DMCA.

We respond expeditiously to valid notices of alleged copyright infringement and take appropriate action, including removal or disabling access to infringing material and termination of repeat infringers where appropriate.

3. Notice of Claimed Copyright Infringement

If you believe that copyrighted material you own or control has been posted on EliteFans.ai without authorization, you may submit a DMCA Notice to our Designated Copyright Agent.

Your notice must include all of the following:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material, including specific URL(s).
  • Your contact information, including name, address, telephone number, and email address.
  • A statement of good-faith belief that use of the material is not authorized.
  • A statement under penalty of perjury that the information provided is accurate and that you are authorized to act.

5. Takedown Procedure

Upon receipt of a valid DMCA Notice:

  • We will expeditiously remove or disable access to the allegedly infringing material.
  • The affected user will be notified.
  • The user may submit a counter-notification if applicable.

EliteFans reserves the right to terminate accounts of repeat copyright infringers.

6. Counter-Notification Procedure

If you believe your material was removed in error, you may submit a counter-notification pursuant to 17 U.S.C. § 512(g).

Your counter-notification must include:

  • Identification of the removed material and original URL.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, physical address, telephone number, and email address.
  • A statement consenting to jurisdiction of the appropriate U.S. Federal District Court and agreeing to accept service of process.

7. Restoration of Material

Upon receipt of a valid counter-notification, EliteFans will forward it to the original claimant.

Unless we receive notice that the claimant has filed a court action seeking an injunction, the removed material may be restored within 10–14 business days.

8. Abuse of the DMCA Process

Knowingly submitting false or misleading notices or counter-notifications may result in legal liability under 17 U.S.C. § 512(f), including damages, court costs, and attorneys’ fees.

EliteFans may take action against users who abuse the DMCA process.

9. Policy Updates

EliteFans reserves the right to modify this DMCA Policy at any time. Any updates will be posted with a revised “Last Updated” date.
